It is totally frustrating multiple attorneys fail to know that Federal jurisdiction over ships and planes does not end at the border (…the way individual state jurisdiction does). Plus it is illegal to deport someone to a place where they will be in harm’s way. These are international laws binding in the US as they’ve been approved by Congress and incorporated into the US Code.

I am incredulous that an AG or assistant thinks that a plane or ship on or over international waters is out of the control of the government & all courts…or tries to bamboozle a judge in that regard.

Having been AG of Florida, which has to control offshore gambling ships and drug running, Pam “Blondie” damned well knows what laws apply within state vs Federal vs international waters.

The point is that international law prohibits the concept of a “stateless” vessel. That law specifically requires that every ship and plane must be “flagged” (registered) in one country or another, and that the "federal" laws of the "flag" country apply to the vessel.

This registration ensures accountability and facilitates the exercise of jurisdiction, allowing states to enforce their laws and regulations on ships and aircraft flying their flag even when they are beyond the flag nation’s territorial limits. While certain laws only apply within each county’s extended economic zone (…such as fishing regulations), most of the national laws of the flag nation are enforceable regardless of where the vessel is. That means that the jurisdiction of the flag nation's federal courts extends into international territory, and even covers such vessels when within another country’s territory.

If this were not the case, it would be possible for someone to commit murder on or over the "high seas" and claim total immunity be virtue of having committed the crime while beyond all national territorial limits.

In regard to ships, the law is the United Nations Convention on the Law of the Sea (UNCLOS), which states that each state must fix the conditions for ships to fly its flag and exercise jurisdiction over them. The definition of what laws apply on board an aircraft bound for an international destination, derives from the 1963 Tokyo Convention (and by the 1944 Chicago Convention to a lesser extent), and is part of Title 49 of the US Code,

The point is that the DC judge had every right to demand that the planes carrying those Venezuelan deportees, denied their rights to due process (…rights that extend to EVERYONE in the US) turn around. For that matter, he most likely can even demand that theose deportees be retrieved from El Salvador. Under US law, ICE effectively kidnapped them.

In addition, Article 33 of the Refugee Convention of 1951, Article 3 of the Convention against Torture, Article 7 of the International Covenant on Civil and Political Rights, Article 22 (8) of the American Convention on Human Rights, and the Convention on the Rights of the Child all either expressly, or implicitly, deal with preventing the exact kinds of dangers deported Salvadorans face upon removal to El Salvador. Individuals in circumstances where they fear violence and persecution are legally protected from deportation proceedings; according to international standards, individuals in such circumstances should not be deported…and the US Secr of State & AG damned well know this, though despicable Residential advisor Steven Miller obviously couldn’t care less.
