The Nigerian constitution is available for the entire world to read, and there is no place in that constitution where the president has been given the power to remove, or suspend, any elected governor, or deputy governor, of any federating unit, called the state. The president does Not have the power to suspend any elected governor, or deputy governor, of any state of the Nigerian federation, including Governor Fubara, or his deputy. Nigeria is headed towards constitutional crisis! The so-called Tinubu sole administrator should Not go near the Rivers State Government House, or any property of Rivers State, or attempt to make any decisions for the good people of Rivers State! People need to be advised about the constitution and the rule of law!

The constitutionality of President Tinubu's declaration of a state of emergency in Rivers State and the suspension of the state's executive governor and legislature for six months depends on the legal framework provided by Nigeria's Constitution, particularly in relation to the powers of the president during a state of emergency.

Constitutional Provisions:
1. State of Emergency (Section 305) The Nigerian Constitution allows the president to declare a state of emergency in any part of the country if there is a situation of "war, invasion, insurrection, or any event or circumstance that threatens the peace, security, or welfare of the country." Section 305 grants the president broad powers to declare such a state under these conditions.

2. Power to Suspend Government Officials: Section 305(3) allows the president, in the event of a state of emergency, to take over the executive powers of the affected state. This includes the ability to suspend or dissolve the state executive and legislature, and appoint an administrator or temporary leadership for the state.

3. Duration: A state of emergency can last for a maximum of 6 months but may be extended with the approval of the National Assembly. This means the president can suspend state officials and take control for a period of 6 months unless extended.

Justification:
If there is a legitimate threat to the peace, security, or welfare of Rivers State (such as violent unrest, a breakdown of law and order, or any other condition that fits within the criteria set forth in the Constitution), the president would be justified in declaring a state of emergency.

Suspension of the Governor, his Deputy and Legislature:
Under Section 305(3), the president does have the authority to suspend the governor, his deputy and the state legislature during a state of emergency. This suspension is meant to restore order and ensure effective governance during a period of instability.

Therefore, the president's actions can be constitutionally justified, if the legal and constitutional procedures are followed, particularly if there is a valid justification for the state of emergency (i.e., a significant threat to peace or security) and if the suspension of the state’s leadership is in line with restoring order.

However, any abuse of this power or a failure to prove the necessity of the state of emergency could be challenged in the courts or by political stakeholders.

The constitution does not provide for the installation of a solad in a State in case of a proclamation of a state of emergency. This is because the constitution doesn't have to contradict itself when it says the executive power of any State of the Federation shall be wielded by an elected governor. And the constitution spells out explicitly how each arm of the government shall be form and power exercised. The constitution states unambiguously that it shall be as laid out in this Constitution.

At any instance of declaration of State of Emergency, the constitution doesn't say the president should bring in a sole administrator to administer the state pending when normalcy is restored.

The governor cannot wittingly write the president to come and sack him and the members of the HoA. And the crisis between the executive and the legislature hasn't gone beyond reach to breach public safety.

Besides, the members of the State HoA refused to sit in order to pass the appropriation bill
Don't forget that the Constitution empowers the governor as the chief executive of the State to withdraw funds from the State purse to implement his budget though such withdrawal must not exceed the limit of his budget
